Williamsburg, NY – Businesses Fear Eminent Domain Will Steal Their Livelihoods for Broadway Triangle

    While the loudest battles over the plan to build 1,895 low-rise apartments on the 31-acre Triangle site have been over the allegations of political corruption, little attention has been focused on the fate of the existing small businesses in the area.

    “I’m just living in limbo,” said Ernie Wong, 33, whose family owns Shanghai Stainless Product & Design Co. on Gerry St. and employs 19 people.

    The Triangle, located on the border between Williamsburg and Bedford-Stuyvesant, is one of a dwindling number of areas in the city zoned for manufacturing.

    The city plans to use eminent domain to force five property owners to sell. Another 14 businesses could be displaced by zoning rules that will limit their activities.

    Wong, whose immigrant parents started the restaurant equipment business in 1989, received a letter in July from the Department of Housing Preservation and Development informing him that if the development plan goes through, it “would authorize the City to acquire your property.”

    “The streets were rampant [then] with drug dealers, prostitutes, crack vials on the floor. “Now that the area’s much nicer, the city wants to come in,” he said. “It’s wrong.”

    HPD officials said displaced businesses will get help finding new space and paying relocation expenses. But the agency said the details won’t be worked out until the plan gets final approval from the City Council.

    Borough President Marty Markowitz signed off on the plan two weeks ago, but said the city should make sure the companies there can stay in business. He recommended putting off acquiring the property until relocation spots are found. He also said property owners should be paid “above and beyond” normal rates, like the city did with businesses at Willets Point in Queens.

    Sara Gelb, 52, started Excellent Bus Service, on Bartlett St., with her husband 25 years ago with one bus. She now has 18, and recently started running service between Brooklyn and Toronto.

    She said that while the neighborhood does need affordable housing – 905 of the new apartments would be affordable to low and middle-income tenants – it needs skilled jobs just as badly.

    “I don’t know what we’re going to do. I still can’t believe that they could actually take away somebody’s property,” Gelb said.

    Michael Retek, 35, runs Smartek, which makes irons and other garment-care products, at another threatened Bartlett St. property.

    “It just doesn’t make sense,” he said. “When business is so tough, in a time when everybody’s cutting jobs and downsizing, let these few businesses live.”

    He rents the space from his father, Abraham Retek, who also rents to a printing shop next door. “I’m not willing to sell it. Why should I sell it?” Abraham Retek said.

    Aaron Jacobowitz, 44, said it took 14 years to build up a customer base at his Bartlett St. flower shop, Floral Expression. Losing the property and relocating would mean starting from scratch.

    “It’s a back-room deal,” he said. “We’re determined to fight it all the way to the end.”

    Opponents charge the land was handed over to two politically connected nonprofits without a fair bidding process. They say Ridgewood-Bushwick Senior Citizens Council and the Hasidic group United Jewish Organizations of Williamsburg used their ties to Brooklyn Democratic boss Assemblyman Vito Lopez (D-Williamsburg) to be tapped as developers. Lopez and the groups have denied the allegation.

    Not only is this unfair, it doesn’t make sense. It’s legalized stealing. I hope these hard-working business owners are left alone.

    it intresting the comments from 2 of the owners . because they knew very clearly before they bought their property that it may be taken due to emenent domain .allso any plan in the broadway triangle would require to take a few properties on that particular block because the city ownes most of that block that those businesses are located . allso all the organizations involved in planing process clearly told the city don’t take any property away. this plan is still better than the original plan of years ago that a few blocks would be taken away.

    I live here, & my neighbors & my family are looking forward to the development of this amazing projects. The only people that oppose it are the alliance of Hispanic & a Satmar faction called Aaronites. These Aaronites are the same faction that went to protest against the counsel last week, & behind the riots in Jerusalem. Irrational!

    To # 2 “Moshe” If you know the area, there are 3 blocks {in the triangle} that are owned by Pfizer {who closed down their facility a while ago} and are just EMPTY.

    Besides, that his whole project anouncement that you heard of, is misleading:
    Look in the official papers, the project on the agenda now (for which the city will pratice amenent domain) is for 95 low income apartments ONLY. again 95, the rest will be in the future, with no current plans.

    Oh, and dont forget, there is a deal with Lopez, (as UJO is going partnership with them on it) so off the 95 minimum of 50% will go to Lopez’s community.

    To Sum it up we are talking about (hopefuly) 47 low income aparments for our community.

    U can all say thank u for stealing our businesses and bringing in another 1000 hispanics n blacks in2 williamsburg to: david niederman from UJO, who has done more damage 2 our nighberhood than marty needelman who officialy represents the hispanics

    Unless they can prove there is no benefit to the public they will lose their claims. Eminent Domain laws have been upheld for years.

    hey for the record ,owners jacobowitz & retek just bought their properties around 5 years ago & they knew very clearly that this area could fall under the eminet dormain,plus I read all the figures & currently with the city & private developers their will be a total of 900 low income apts & 1100 normal priced

    I have my business around the corner & I am following this closely, this is the best thing that can be for the community,

    The fact is the city owned 95% of the lots
    The city will find for each business owner a place within the 1/2 mile!
    The city will pay the moving expense

    All these owners (retek, jakobowits, etc) are nothing but just selfish
    The fact is that the city executed the amend domain years ago, & all the buyers know about it, & that’s why they paid a cheap price, not to mention that the city offered for these guys to give the 95% lots the city owned to them for free, but they have to develop! But they refused!
    To me just to say NO to everything because a little in convince, is selfish!!!

    Not to mention that the amount of owners benefiting from this re zoning is 10 times the amount of this few people!!

    as a matter of fact, Excelent Bus service was in court TRYING to buy a city lot adjoining theirs and the city REFUSED!!!

    Mayor Bloomberg just wants to look good before the election showing that he is building low family housing no matter how many people ‘s jobs and businesses he destroys! I hope VIN posts this!

    The concept of taking land away from private owners for the greater public good was endorsed in the gemorah although it was obviously not called eminent domain. As long as there is some type of compensation paid, there is no issur against such “takings”.
