NEW YORK (VINnews) — The Anti-Semitic thug who threatened two Jews in Costco with physical and gun violence is back on New York streets.

Justin Pichazaca, a Jamaica, Queens resident was arrested on Monday after he was filmed going on a vile expletive-filled rant against a Jew in a Five Towns Costco store on Sunday, telling him “the Nazis will ****ing kill you.” The video also shows him lunging at least twice towards his victim, and telling him “I’ll pull out the gun and smack the **** outta you”.

Pichazaca also attacked another Jew in the store that same day, when he hurled anti-Semitic obscenities at a Jewish boy. When the boy’s father intervened, he said, “I’m going out to get my gun and will come back to shoot you up.”

Pichazaca was arrested on Monday, after the original police officers who responded to the incident on Sunday opted to not take any action against Pichazaca, despite the obvious hate crime, instead calling the Jewish victim an aggressor. As previously reported, the police department has since apologized to the victim and stated that the original police responders will receive a re-training.

Pichazaca was arraigned Tuesday morning, and was charged with 2 counts of aggravated assault and one count of menacing as a hate crime.

He has been released on ROR (release on your own recognizance), which means the court receives a written promise signed by the defendant promising that they will show up for future court appearances and not engage in illegal activity while out on an ROR.

He could not have been held on those charges. Release on his own recognizance isn’t unusual for such a charge As vile as he is doesn’t mean he deserves imprisonment awaiting trial
