Jewish School Sues Miami Beach Edan Rock Hotel For $2.3 Million Refund After Canceling Passover Vacation For 1,200

MIAMI (JTA) – A Jewish day school in New York City has sued a Miami Beach hotel for a refund after canceling a 10-night Passover vacation due to the coronavirus crisis.

Students, parents and staff of the Magen David Yeshivah in Brooklyn had rented 621 rooms for about 1,200 guests for the April program at the Eden Roc hotel. The down payment for the vacation was $2.3 million.

The school filed its lawsuit in Miami-Dade Circuit Court, the Miami Herald reported Tuesday, on the basis of a clause in the contract that said the reservation could be canceled in the event of a “disease outbreak.” The hotel is demanding that the event be rescheduled for later in the year or proceed as scheduled.

Magen David canceled the event by March 18, the newspaper reported, and two days later New Yorkers were ordered to remain in their homes, with travel forbidden. Meanwhile, Miami Beach ordered hotels to close and cancel reservations.

The school first held a Passover event in 2018, and returned in 2019, according to the report, after which it signed a three-year contract with the hotel.

Magen David runs from early childhood to high school and is “rooted in the Sephardic tradition,” according to the school’s website.

  1. What am I missing here? On what basis are they refusing to refund the deposot if hotels were ordered to cancel reservations? What does the hotel think?

    • No basis. They’re just buying time. Lawsuits can take years to recover funds, and the right anti semitic judge might be persuaded to ignore a black and white contract in what should be an open and shut case. Throw around wokeness and social justice and other ridiculous phrases, and it’s always worth mugging someone on the chance that the court system might say it’s fine.

      • ” No Basis” True. Its called “Art of the Deal.” Trump did it all his life. Never paid a bill in full. “Bankruptcy” is a smart business deal. Eden Roc and many if not most hotels will declare Bankrupt and start under a new Corporation at worst. At best they will give back 10 c on the $. ART OF THE DEAL. Trump University ? Remember. He stole over 400 million and paid back 35 million. Its done daily. Ask any Wealthy Yid.

          • To ask the question is to answer it. They’re bitter, jealous people, who can’t imagine how someone like Trump, or “any Wealthy Yid,” actually accomplished anything useful in life, so they naturally assume that it must have been done in some underhanded fashion.

        • When Fred Trump was alive vendors and contractors who were refused payment by Donald were able to get payment from Fred. Atlantic City contractors lost their businesses when Trump found excuses not to pay for their wiork.

    • Really? I wasn’t aware that the governors of Michigan or Nevada, who have denied a lifesaving treatment for the virus for no other reason than because Trump promoted it, have the ability to order a lockdown for Florida. Oh, and by the way, they’re both Democrats, the party of anti-Americanism, anti-Semitism and corruption.

  2. I cannot imagine why a lawsuit is required. Hotel chains must be handing out refunds with a shovel. I wonder why they are being difficult on this case.

  3. Ay Way. The best thing happened . Maybe they will think next time what to do with 2.3 m. How about it buys 200 ventilators and could save many Jewish life

“they say that the school should re-schedule the passover event for later in the year! HA!”

  5. 2.3 is just the deposit the bill annually is way more .. tzedaka question is out of context , firtly most yidden who have money give & give .. its very difficult to be a rich frum guy & not give from the social angle
i am a regular working guy yet the torah allows wealthy people to live a diff lifestyle ( within reason) yes for him its ok for me its not
the problem w pesach hotels is not the money , it is that many times the atmosphere is the opposite of yetzias mitzrayim although some aspects of menucha are there in a hotel ( if you are reading diff hagados and seforim because you DONT have to peel & cook but by n large the gashmius is a shter to the real cheirus
