Beit Shemesh Resident Remains In Custody Because He Refuses Electronic Handcuff On Shabbos

JERUSALEM (VINnews) — The Jerusalem District Court ruled that Binyamin Friedman, a Chareidi resident of Beit Shemesh who allegedly attacked policemen disbanding an illegal minyan in his town two months ago, will remain in custody, despite the court’s willingness to allow him to be in house arrest with an electronic handcuff. Friedman had requested that the handcuff be released on Shabbat and festivals in order to prevent unnecessary desecration of the Shabbat. The Jerusalem Magistrates Court acceded to Friedman’s request since there was no reason to assume that Friedman would desecrate the Shabbat and escape when the electronic handcuff was not on him.

However the state appealed to the District Court, demanding that the handcuff be left on at all times. The court accepted the appeal and ordered Friedman to remain in custody until he agrees to wear the electronic handcuff at all times.

Attorney Roy Politi representing Friedman told B’Chadrei Charedim that “we are considering our next steps due to the difficulty arising from compelling a person to choose between desecrating the Shabbat or accepting a lengthy detainment which in our opinion is unjustified.”

The indictment against Friedman states that when police arrived to disperse an illegal minyan including Friedman he refused to leave, shouted at the police and cursed them even after being repeatedly warned about his behavior.

Three cheers for the District Court. Thugs like this need to understand that the world does not respect their worldview which says you can do whatever you want and then plead special circumstances. All the Botei Din and Rabbonim that spoke out about this made it clear that people should not participate in these illegal minyonim.
